LIMITED 3 YEAR LABOR WARRANTY


Custom Design Performance (hereinafter referred to as 'C.D.P.') warrants that their Hi-Performance Street engines shall be free of defects from workmanship, when installed properly by a competent technician used for normal street operation and serviced at proper intervals, for a period of three years, from date of invoice.

This warranty is expressly in lieu of any other warranty expressed or implied, including but not limited to, merchantability or fitness for a particular purpose, and all other obligations or liabilities on part of Custom Design Performance. By purchasing this engine it is understood that the customer accepts and agrees to comply with the terms of this warranty.

Custom Design Performance will provide full labor repairs and replacement of all parts needed to repair your engine in the event of a problem upon start up. Inspection of the engine must be completed by C.D.P. to assure that the engine was not run any longer than a few hours. If C.D.P. finds that the engine was run longer than a few hours, the original '3 Year Labor Warranty' will apply.

Custom Design Performance, under the '3 Year Labor Warranty', will provide all repair labor, inspection, machining, and assembly at no cost to the original purchaser of the engine. The purchaser will be responsible for the cost of all parts needed to repair the engine under the '3 Year Labor Warranty', which must be purchased threw Custom Design Performance. This warranty only covers the engine itself. At no time does this warranty or any other warranty given by C.D.P. cover the labor costs to remove or replace the engine from the vehicle, or does it pay the labor costs of any mechanic. The purchaser is responsible for all shipping charges in any and all warranty cases.
NO EXCEPTIONS!

OWNER OBLIGATIONS:

  • 1. Prime the engine before starting! This makes sure that engine oil is getting to the top of the engine on both sides. Use an old distributor that has been modified or use one of the aftermarket primers with the sleeves on the shaft to force oil into all the oil galleries! Failure to do so voids this warranty!

  • 2. Flush or replace oil cooler, if equipped, as this will let contaminated oil into the new motor. Failure to do so voids warranty! Remember, the first 10-15 minutes of engine break-in are the most important in a new engines life!

  • 3. Upon initial start-up, engine must be run at 1600-1800 varying rpm's to help the camshaft & lifters properly seat themselves. Run motor this way until it reaches normal operating temperature, then shut motor down. While motor is cooling down, cylinder heads, intake manifold, valve covers, exhaust manifolds, and all other accessories & brackets must be re torqued, and all valves must be re-adjusted to manufacturer's specifications.

  • 4. All engines equipped with an aluminum intake manifold must be re-torqued frequently for the first month, and then periodically checked there after.

  • 5. All engines with Aluminum Cylinder Heads must be re-torqued at this time!

  • 6. Check all belts and hoses, and look for oil leaks. If you find any oil leaks, notice anything that doesn't look or sound right, contact Custom Design Performance immediately! and do not continue to run the engine.

  • 7. Now you are ready to drive your vehicle on the street. Do NOT let the new motor idle for long periods of time, as this will not let splash oil to lubricate vital engine components. Also, do not take long drives on the highway where the rpm’s will not vary. Do not baby the motor while first driving it, but also don’t beat on it. Drive it like you are going to drive the motor normally.

  • 8. The engine's oil and filter must be initially changed at 100-150 miles, and then at every 3,000 miles or 3 months, whichever occurs first. You will be required to furnish proof of these services if a warranty claim has to be made. FAILURE TO PERFORM ANY OF THESE OPERATIONS VOIDS WARRANTY.

  • EXCLUSIONS AND LIMITATIONS:

    This Warranty does not cover damage or loss due to the following services:

  • 1. Misuse, maintenance neglect, abuse, vandalism, abnormal operation or accidents, not changing the oil at required intervals , or not enough oil.

  • 2. Defective or improper installation

  • 3. Defective or improper installation of distributor, carburetor, or other accessories, that could cause melted pistons & rings, and/or destroyed bearings.

  • 4. Improper break-in procedures, possibly damaging camshaft, lifters, or pistons and rings.

  • 5. Improper flywheel/flex plate torque.

  • 6. Over revving or abuse that could cause bent or broken connecting rods, or bent or broken push rods, or broken valve springs.

  • 7. Environmental conditions, over heating or freeze cracks from lack of coolant.

  • 8. Burned, scored or melted pistons from pre-ignition, or detonation, or lack of lubrication.

  • 9. Damage done by racing or competition or other non vehicle usage.

  • 10. Foreign material in combustion chambers or oil pan from improper installation.

  • 11. Failure of components or parts not furnished or otherwise approved by C.D.P. for installation, or components or parts unsuitable for use with said engine.

  • 12. Damage to pistons and other components from components from detonation or pre-ignition. Distributor not installed correctly, too much timing, bad fuel, and too low of octane for compression ratio.

  • 13. Crankshaft thrust bearing surface worn. Defective or improperly installed clutch, or torque converter.

  • 14. Internal modifications not authorized by C.D.P. Any internal modifications will result in voiding warranty.

  • 15. Nitrous Oxide or Supercharger: Installing these components on an engine that wasn’t properly built for them will void the warranty. We can custom build you an engine suitable for these applications, but must be told in advance.

  • 16. Over fueling, over carbureting, poor ignition, or other dilution of lubrication will void warranty.

  • 17. Abnormal wear, tear, abuse, or use of an engine other than for which it was originally intended.

  • 18. Subsequent damage to engine due to the failure of the operator to immediately cease operating and protect the vehicle when a failure has occurred.

  • 19. Please remember, we take great pride in our workmanship, and we hope you do to. If you have any problem at all please contact us first. 99% of the time a problem can be solved without having to ship the engine back to C.D.P. for repair. And please remember, we try to use the best parts available on the market, but we do not manufacture the parts, so if there is a parts failure we will try to work with you the best we can.

  • This warranty does not cover or provide payment or reimbursement for the following services:

  • 1. Replacement of oil, anti freeze, fluids, or any other substances.
  • 2. Towing charges, vehicle rental or other substitute transportation
  • 3. Diagnostic time, labor to remove and/or reinstall engine, or service calls
  • 4. Parts or items associated with warranted engine
  • 5. Transportation or lodging
  • 6. Loss of time, income, sales or profits, loss of use of vehicle
  • 7. Lift, dock or storage fees
  • 8. Tune-ups or replacement of belts, hoses or maintenance items, routine, regularly required maintenance
  • 9. Injury or death to persons or damage or destruction of property; consequential or incidental damages
  • 10. Shipping warranted engine to and from Custom Design Performance

  • CLAIM PROCEDURE:

    Immediately after the discovery of a potential defect the customer must comply with the following procedure:
  • 1. Discontinue the use of the engine.
  • 2. Do not pull engine out of vehicle.
  • 3. Contact the sales person at C.D.P. that you originally purchased the engine from.
  • 4. Let C.D.P. help you figure out what is wrong with the engine; ( 99% of the problems can be fixed with the help from a C.D.P. Tech while the engine is still in the vehicle. )
  • 5. Unless a field repair is specifically authorized by C.D.P., the engine or part thought to be defective must be returned to C.D.P. for evaluation. A copy of the customer’s original invoice or receipt must accompany all returned engines or parts. Due to the nature of our business, NO refunds are allowed on engines purchased from C.D.P. for any reason. NO EXCEPTIONS !
  • 6. Returned engines must be returned with all parts intact that were originally supplied with the engine, or charges will be made for the missing parts.
  • 7. Disassembly of the engine by any parties other than C.D.P. will void the warranty, unless it is specifically authorized by C.D.P.

  • BY PURCHASING THIS ENGINE FORM CUSTOM DESIGN PERORMANCE (C.D.P.) IT IS UNDERSTOOD THAT THE CUSTOMER ACCEPTS AND AGREES TO COMPLY WITH THE TERMS OF THE WARRANTY.

    A SIGNED COPY OF THIS WARRANTY MUST BE RETURNED WITHIN 10 DAYS OF RECEIVING THE ENGINE. FAILURE TO DO SO WILL VOID ANY AND ALL WARRANTIES.

    BINDING ARBITRATION

    PLEASE READ THE FOLLOWING CAREFULLY, IT CONTAINS VERY IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS AS WELL AS LIMITATIONS AND EXCLUSIONS THAT MAY APPLY TO YOU. THIS DOCUMENT CONTAINS A DISPUTE RESOLUTION CLAUSE.
    Any claim against Custom Design Performance (hereinafter referred to as 'C.D.P.') its agents, employees, successors, assigns, or affiliates arising from or relating to the purchase of parts or an engine this or this agreement, or it's interpretation or the breach, termination or validity thereof, the relationships which result from this agreement (including, to the full extent permitted by applicable law, relationships with third parties who are not signatories to this agreement), C.D.P.'s advertising or any related purchase SHALL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION ADMINISTERED BY A STATE OR NATIONALLY RECOGNIZED ARBITRATION FIRM. The arbitration will be limited solely to the dispute or controversy between customer and C.D.P. These terms and conditions apply (1) unless the customer has signed a separate purchase and sale agreement with C.D.P., in which case the separate agreement shall govern, or (2) unless other standard C.D.P. terms apply to this transaction.

    FORUM SELECTION CLAUSE:

    It is agreed to by and between customer and C.D.P. that all disputes and matters whatsoever arising under, in connection with or without incident to this contract, warranty SHALL BE ARBITRATED EXCLUSIVELY IN AND BEFORE A COURT LOCATED IN THE STATE OF CONNECTICUT, TO THE EXCLUSION OF THE COURTS OF ANY OTHER STATE, TERRITORY, OR COUNTRY. This is enforceable on all contracts regardless to where product has been shipped. Customer hereby waives any venue or other objection that he may have to any such action or proceeding being brought in any court located in the State of Connecticut. If either party is to institute or commence litigation in any venue or format other than that specified above, specifically binding arbitration in Connecticut it shall be liable to the other for all costs, expenses, and attorney fees associated with that action.
